A party can request the court to change his or her name so long as they can show reason for needing or desiring the name change and there is no fraudulent or illegal purpose behind the name change. If a party wishes to return to a former or maiden name, then a petition package can simply be filed without having to file a criminal background check.
If a person is not returning to a former name, fingerprints must be submitted to the clerk of court and a criminal background check must be run through the Florida Department of Law Enforcement. A person must petition the court, attend a hearing, and obtain a Final Judgment of Name Change unless the individual is changing his or her name through a divorce or an adoption proceeding.
